Truckbud Terms of Use

These Customer Terms of Use govern your use of the Truckbud platform to book large item delivery services. They form a binding agreement between you and Trualr Technologies Inc. carrying on business as Truckbud ("Truckbud," "we," "us," or "our"). By submitting a booking through the Truckbud platform (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.

Nature of the Platform

Truckbud as Marketplace and Standards Operator

Truckbud operates a technology platform that connects customers who need large items delivered with independent local drivers who provide delivery services. While Truckbud does not directly perform delivery services, Truckbud sets and enforces the qualification standards all drivers must meet, requires background checks and vehicle verification before any driver completes a delivery, and takes responsibility for the standards of the driver network as a whole.

Truckbud is not a passive intermediary. We select and qualify the drivers on our platform, communicate with customers on their behalf, and hold our drivers accountable to defined service standards. If the Truckbud standard is not met on a delivery, we want to know.

No Guarantee of Availability

Truckbud does not guarantee driver availability for any particular date, time window, or geographic area. Availability is displayed in the booking flow and reflects real-time driver capacity. Truckbud will make reasonable efforts to fulfil confirmed bookings but is not liable for inability to complete a delivery due to circumstances outside its reasonable control, including weather events, road conditions, or driver unavailability.

Booking Process

Your Booking

When you submit a booking through the Platform, you are requesting a delivery from a Truckbud driver. By submitting a booking you confirm that: (i) the pickup and drop-off addresses, items, access details, and other information you have provided are accurate; (ii) you are at least 18 years of age; (iii) you have authority to arrange delivery of the items specified, including the legal right to possess and transport those items; and (iv) someone authorised by you will be available at the drop-off address to receive the delivery.

Booking Confirmation

Your booking is confirmed when you receive a confirmation message from Truckbud. The confirmed price shown at the time of booking is the price you will pay. Truckbud will not charge you any amount beyond the confirmed price without notifying you and obtaining your agreement first.

Accurate Information

You are responsible for providing accurate information when booking. Inaccurate information about item size, weight, access requirements, or delivery conditions may affect your driver's ability to complete the delivery and may result in additional charges, delays, or cancellation of the job. If you discover an error after confirming, contact support@truckbud.ca as soon as possible.

Pricing and Payment

Pricing

The price displayed at the time of booking is calculated based on your pickup and drop-off addresses, distance, the items selected, any service add-ons (including inside delivery and stair access), and applicable taxes. The price you see before confirming is the price you pay. For the purposes of this section: "Inside delivery" means placement of items into the room of your choice on any floor of the drop-off address; "Stair carry" means manual carry of items up or down stairs where elevator access is unavailable or impractical. Both services must be selected and paid for at the time of booking.

Payment Timing

Payment is collected when your driver arrives at the pickup address and your items are loaded and ready for transport. You are not charged at the time of booking. If a pickup cannot be completed for any reason, no payment is collected.

You do not pay anything when you book. Payment is triggered when your driver arrives at the pickup address and items are loaded — not before.

Accepted Payment Methods

Payment is processed digitally. Accepted methods include: debit card, credit card (Visa, Mastercard), and Interac e-transfer. Cash is not accepted.

Delivery and Customer Obligations

Receiving Your Delivery

You or an authorised representative must be available at the drop-off address to receive the delivery, particularly if inside delivery has been selected. If no one is available at the drop-off address when your driver arrives, the driver may not be able to complete the delivery, and you may be responsible for applicable charges.

Item Condition and Eligibility

You are responsible for ensuring that items submitted for delivery are accurately described, safely prepared for transport, and do not include any prohibited or hazardous materials. Truckbud drivers are not required to accept items that are significantly different from what was described in the booking, are unsafe to transport, or that contain prohibited materials.

Prohibited Items

The following items may not be transported through the Truckbud platform: illegal items of any kind; hazardous, flammable, or corrosive materials; live animals; items requiring a regulated transport permit; or items that are unsafe to transport in the vehicle types available on the Platform. Attempting to book transport of prohibited items may result in cancellation of the booking and removal from the Platform.

Access and Preparation

You are responsible for ensuring that access to both the pickup and drop-off addresses is as described in your booking. If access conditions at either location are materially different from what was described at booking, your driver may be unable to complete the delivery as scoped, and additional charges may apply.

Cancellation and Changes

Cancellation Before Dispatch

You may cancel your booking before your driver has been dispatched at no charge. To cancel, contact support@truckbud.ca with your booking reference number as soon as possible. No payment is collected for bookings cancelled before dispatch.

Cancellation After Dispatch

Once your driver has been dispatched and is en route to the pickup address, a cancellation fee of up to $50 may apply to compensate the driver for time and fuel. The exact fee will depend on how far the driver has travelled toward the pickup. Contact support@truckbud.ca immediately if your situation changes — the earlier you reach out, the lower any applicable fee.

Changes to Your Booking

If you need to change your booking details after confirmation, contact support@truckbud.ca with your booking reference number as soon as possible. We will do our best to accommodate the change depending on where your driver is in the process. Material changes may result in a price adjustment.

Always include your booking reference number when contacting support. It is in your booking confirmation and allows our team to locate your job immediately.

Service Standards and Concerns

Service Standard

Truckbud maintains a defined service standard for all deliveries: drivers arrive within the agreed time window, handle items with reasonable care, communicate proactively, and behave professionally with customers and sellers at all times.

If the Standard Was Not Met

If you believe your delivery did not meet the Truckbud service standard, contact support@truckbud.ca as soon as possible after your delivery. Include: your booking reference number, a brief description of what happened, and photos if relevant. We respond within one business day and will follow up with any questions needed to look into the situation.

Scope of Review

Our review process assesses whether the Truckbud service standard was met. Concerns related to circumstances outside the driver's reasonable control — including weather, traffic, or inaccurate information provided at booking — may not constitute a service failure. We will always acknowledge and respond to your message.

Item Damage Claims

If an item is damaged or lost during your delivery, report it to support@truckbud.ca within 48 hours of delivery completion. Include: your booking reference number, a description of the damage or loss, photographs of the item showing the damage, and proof of item value (purchase receipt, listing price, or comparable replacement price).

Truckbud will acknowledge your claim within one business day and complete its review within 10 business days of receiving all required documentation. Truckbud is not responsible for damage to items that were improperly prepared for transport, misdescribed in the booking, or had pre-existing damage not reported before pickup.

Tracking and Communication

After you confirm your booking, you will receive SMS updates including: booking confirmation, driver matched, driver on the way to pickup, items picked up and heading to you, and delivery complete. All messages are sent to the phone number you provided at booking. Real-time tracking requires no additional app or download.

Limitation of Liability

General Liability Cap

To the maximum extent permitted by applicable law, Truckbud's total aggregate liability to you for any claim arising from or related to the Platform shall not exceed the greater of: (a) the total charges you have paid through the Platform in the twelve months preceding the event giving rise to the claim; or (b) CAD $500.

Item Damage Claims

If an item is damaged or lost during a delivery arranged through the Platform, Truckbud's liability for that item is limited to the lesser of: (a) the declared value of the item as provided by you at the time of booking; or (b) the reasonable replacement cost of the item. If you did not declare an item value at booking, Truckbud's liability for item damage on that delivery is limited to CAD $1,000.

Exclusion of Indirect Damages

Truckbud shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or related to your use of the Platform or any delivery arranged through it, even if Truckbud has been advised of the possibility of such damages.

Preserved Liability

Nothing in this section limits liability for death or personal injury caused by gross negligence or wilful misconduct.

Data and Privacy

Your use of the Platform is subject to Truckbud's Privacy Policy, which describes how we collect, use, and disclose your personal information. By using the Platform you consent to the data practices described in the Privacy Policy.

To complete your delivery, we share the following information with your assigned driver: your first name, pickup and drop-off addresses, item descriptions, and any access instructions you provide. We share only the minimum information necessary to facilitate the delivery. Your phone number is not shared directly with the driver; communication is routed through the Platform.

We do not sell your personal information to third parties.

Dispute Resolution

Informal Resolution

If you have a concern arising from a delivery or your use of the Platform, we encourage you to contact us first at support@truckbud.ca before initiating any formal proceeding. Truckbud will make reasonable efforts to resolve the issue within 14 business days of receiving your message.

Governing Law

These Terms are governed by the laws of the Province of Manitoba and the applicable federal laws of Canada. Any disputes that cannot be resolved informally will be resolved in the courts of Manitoba.

General Provisions

Amendment

Truckbud may amend these Terms from time to time. Material changes will be communicated to you at least 30 days before the effective date by email or through the Platform. Your continued use of the Platform after the effective date of any amendment constitutes acceptance of the updated Terms. If you do not agree with a material change, you may stop using the Platform before the effective date.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
